Terms of Use

These Terms govern your use of LaterLarry — the private guest-risk register for South African hotels, guesthouses and lodges. By registering an account, you agree to them on behalf of your establishment.

Placeholder notice. This document is a good-faith working draft written in plain English. Before public launch, LaterLarry (Pty) Ltd will engage a South African attorney specialising in POPIA and defamation law to finalise this text. Nothing here should be relied upon as legal advice.

1. Who these terms are between

These Terms of Use are a legally binding agreement between LaterLarry (Pty) Ltd ("LaterLarry", "we", "us") and the hotel, guesthouse, lodge, short-stay host, chain operator or booking agent ("you", "the Hotel") that registers an account on laterlarry.co.za.

2. What LaterLarry does

LaterLarry provides a private, moderated, POPIA-compliant database in which member Hotels can (a) search for prior incident reports about a prospective guest, and (b) submit reports about guests who have caused loss or harm during a stay. LaterLarry is not a debt-collection agency, credit bureau, or law-enforcement body. The database is not publicly accessible.

3. Your account

  • You must provide accurate registration details and keep them current.
  • You are responsible for all activity on your account. Use a strong password and enable two-factor authentication.
  • Sharing accounts between properties or reselling access is not permitted.
  • We may suspend or terminate accounts that breach these Terms without notice.

4. Reporting rules (please read carefully)

  • Every report must be made in good faith and be based on facts you can substantiate with evidence (photos, invoices, booking references, police case numbers where applicable).
  • You must not submit reports that are false, exaggerated, retaliatory, or discriminatory on any prohibited ground (race, gender, sexuality, religion, disability, nationality, etc.).
  • You warrant that you have the legal right to submit the guest's personal information for this purpose in terms of POPIA §11 (legitimate interest in fraud prevention and safety).
  • All reports are moderated by LaterLarry before publication. We may reject or amend reports that do not meet our evidence and tone standards.
  • Guests have a right of reply. If a guest successfully appeals a report, it will be removed and your account may be reviewed.
  • Filing knowingly false reports is grounds for immediate termination and may result in civil liability to the guest and to LaterLarry.

5. Search & screening rules

  • You may only search the database in connection with a booking or check-in decision for a specific guest.
  • You may not bulk-download, scrape, resell, or otherwise redistribute data obtained from LaterLarry.
  • You may not use LaterLarry data to harass a guest or to make decisions on prohibited discriminatory grounds.

6. Fees, subscriptions and refunds

  • Fees for paid tiers (Standard, Pro, Enterprise) are shown on our pricing page in ZAR and are billed via Paystack.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your billing page; access continues to the end of the paid period.
  • Fees already paid are non-refundable except where required by South African consumer protection law.

7. Your liabilities and indemnity

You are solely responsible for the accuracy and lawfulness of every report you submit. You indemnify LaterLarry against any claim, loss, cost or damage (including reasonable legal fees) arising from a report you submitted that was inaccurate, defamatory, or otherwise unlawful. LaterLarry's aggregate liability to you is limited to the fees you paid in the twelve months preceding the claim.

8. Termination

Either party may terminate this agreement at any time. On termination, your access is suspended, but reports you submitted may remain in the database subject to their retention period and any pending appeals. Personal data belonging to your account users will be deleted or anonymised on request in accordance with our Privacy Policy.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town.

10. Changes

We may update these Terms from time to time. Material changes will be emailed to your registered contact address and shown on your dashboard on next sign-in. Continuing to use LaterLarry after a change means you accept the updated Terms.
